Yesterday, we discussed the legal definition of intoxication and noted
that there are two ways to be intoxicated. If a person does not have normal
use of his or her mental or physical faculties, then he or she can be
considered intoxicated. Also, if a person has a BAC level of 0.08. What
does this mean?
Alcohol concentration is defined by statute as (1) the number of grams
of alcohol per 100 milliliters of blood; (2) the number of grams of alcohol
per 210 liters of breath; or (3) the number of grams of alcohol per 67
milliliters of urine. Did your eyes glaze over when you started reading
this? If so, you are not alone.
Most people will not be able to tell on their own what their intoxication
level is when they are drinking. The results will be given by a machine
called an Intoxilyzer 5000. Most intoxilyzer operators are not fully versed
in the science behind the machine, but courts do not require an operator
to fully explain the science.
