A lesbian couple that married in Washington D.C. filed to dissolve their
divorce this week in a Texas court. The couple now lives in San Antonio.
According to the San Antonio Express-News, this is the first divorce case
between a homosexual couple that has been sought in Bexar County. Texas
does not currently recognize same-sex marriages or divorces. Eight days
after the original filing on February 18th, A U.S. District Judge ruled
that Texas’ same-sex marriage ban is unconstitutional.
Unfortunately, the ruling that was pending appeal was stayed. The lesbian
couple may find their divorce on hold until the Texas Supreme Court takes
up the case about whether to allow same sex couples to file for divorce
in Texas. The state has already worked on cases involving divorce. A couple
in Austin were granted a
divorce after they argued that the state didn’t need to recognize the validity
of same-sex marriage in order to dissolve a union that was already legal.
The San Antonio couple that recently filed for divorce says that they want
their case to move forward in Texas because the women are battling for
custody of their child. THey have a 13-month-old daughter. One of the
partners in the relationship says that she wants to share custody, while
the other doesn’t want to because she is the only biological parent.
