A Texas divorcee recently chose to sue his attorney after the lawyer signed
an agreement to give the ex-wife 50 percent of his retirement account.
The plaintiff claims that he never authorized he signature. He filed his
lawsuit against the attorney in a Jefferson County District Court, citing
criminal negligence, gross negligence, breach of duty fair dealing and
breach of fiduciary duty.
The plaintiff says that he married his wife back in 2008, and was represented
by a divorce attorney when he filed for divorce. The marriage was short,
so the plaintiff made it clear that his ex-wife should only receive a
fraction of his retirement account. However, Bonham later signed off on
qualified domestic relations orders that allocated 50 percent of his retirement
account. The plaintiff now wants damages after he has lost so much of
his account. He is being represented by a different lawyer.
