Texas Child Kept Away from Drug-Using Parents

The Texas courts decide child custody matters in a way that reflects the best interests of the child. This is why individuals that use strong narcotics or do not care for their children can be severely punished and their children can be taken away from them. Texan parents must prove that they are a safe and reliable parent in order to provide for their child.

Recently, a couple in Texas was found in a van littered with heroin needles. Their child stood naked in the van while the parents engaged in sexual behavior. According to reports, the young child tested positive for methadone and amphetamine at her birth and the girls' mother confessed that she used heroin about a week prior to going into labor with the child.

The Department of Family and Protective Services determined that the environment was not sage for this child and that emergency removal should be initiated. The state had already removed a small boy from the same mother's custody. The mother was arrested and convicted of possession with a controlled substance, endangering a child and interference with child custody. She is scheduled to get out of prison in November of 2014.

A foster family caring for the child's older brother also took the girl in, and the biological parents no longer have parental rights.
