Can I be Arrested for Gambling in Texas?

Gambling is an activity that is commonly practiced, even if it isn’t exactly legal. According to the Texas Penal Code §47.02, a person commits an offense if he makes a bet on the partial or final result of a game or contest or makes a bet on a political nomination, appointment, or election. If the actor engaged in gambling in a private location or there was no economic benefit to the game other than personal winnings, then he or she may be able to argue a gambling charge and get it excused. As well, the Texas Penal Code says that if the chances of losing or winning were relatively the same for all participants, then gambling may be permitted. The Texas Racing Act permits some forms of gambling are permitted under the law. Owning a gambling house is another sensitive issue in Texas.
