Biden’s 8-Year Path to Citizenship: What You Should Know

As of March 2021, there are more than 11 million undocumented immigrants living in the United States. Although many fear deportation or worse, the Biden administration has taken a new tack at offering a path to citizenship for these immigrants. The proposed legislation would allow undocumented immigrants to lie and work in the United States for 5 years upon passing a background check and paying taxes. After that time is up, they can apply for a green card, which would give them permanent status in the United States and the opportunity to apply for citizenship after 3 more years.

Some undocumented immigrants would qualify more immediately for green cards, such as “Dreamers,” the young undocumented immigrants who were brought to the U.S. as children. Others who would be protected include agricultural workers and those under temporary protected status if they are working or in school. Only undocumented immigrants who were in the country by January 1st, 2021 would be eligible under Biden’s plan for a path to citizenship.

Will the Immigration Reform Laws Pass?

Biden’s plan would make the most far-reaching immigration law changes the country has seen in more than 30 years. This would make it easier for family-based immigrations, where spouses and children join their families already in the U.S. However, this immigration overhaul is no guaranteed. Immigration reform is a lengthy process, and undocumented immigrants are advised to seek the counsel of an immigration attorney familiar with the laws of the United States, so they have the best chance of remaining in the country.

It remains to be seen whether sweeping immigration reform laws will pass. Republican lawmakers, such as Representative Bill Johnson (R – Ohio) have stated the administration’s focus should be on Americans struggling right now rather than on undocumented immigrants. Other republicans are concerned about border security and remain attached to former President Trump’s “border wall” plan that would block illegal immigration from the southern U.S. border.
