DWI With Bodily Injury in Plano

Intoxication Assault Charges in Plano

In Texas, when a driver injures someone else as a result of drunk driving, it’s referred to as “intoxication assault” under Section 49.07 of the Texas Penal Code. A person commits “intoxication assault” if while driving under the influence of alcohol or drugs, he or she causes serious bodily injury to another person.

Intoxication assault is a felony of the third degree, punishable by 2 to 10 years in prison, and by a fine not to exceed $10,000.
