What Charges Will I Face for Robbery?

Robbery is defined in Texas Penal Code § 29 as committing theft, in the course of which the offender intentionally or recklessly causes injury to another person or willfully threatens another person with injury or death. Robbery is a second degree felony and may be punishable by 2 to 20 years in state prison and a fine of up to $10,000. In some situations, enhanced charges may be incurred.

What is Aggravated Robbery?

Aggravated robbery is a more serious type of this offense.

It involves committing robbery with any of the following aggravating circumstances:

  • Serious bodily injury was caused to another person
  • The defendant was in possession of or used a deadly weapon
  • The victim was 65 years or older or was a disabled person

Aggravated robbery is a first degree felony and may be punishable by 2 to 99 years or life in prison.
