The officers stated that they had their badges visible when the asked for
consent to search Wenzell's apartment. Wenzell admitted to having
marijuana in the apartment, but provided a prescription drug for it. They
also claimed that the defendant gave them permission to enter the apartment
and conduct a search of the apartment. However, video evidence clearly
demonstrated that the officers just followed the defendant inside and
he did not expressly give consent.
