Deferred Adjudication For DWI?

Over the past several years, the Texas Legislature has attempted to pass a bill that will allow deferred adjudication for those that commit the offense of driving while intoxicated. This is supposed to be a viable alternative for those that make a mistake and want to move with their life. After all, a person who has been charged with much more serious offense can be eligible for deferred adjudication.

This session there was across the line support to pass House Bill 189 or Senate Bill 903 that would allow first time offenders to be placed on deferred adjudication. Organizations such as MADD and Texas prosecutorial agencies and groups even supported this bill. Both died in the Senate Criminal Justice Committee.
