Doctor Sentenced for Deadly DWI

Earlier this week, Doctor Steven DiVito received 5-15 years in prison for driving while intoxicated and vehicular assault, and manslaughter. In November of 2011, police report that Divito was under the influence of alcohol as he sped down a highway near Lake Ontario. The forty-year-old chiropractor crashed his SUV into another car near an intersection and killed its two passengers, Patricia and James DePinto. Instead of stopping to assist the occupants, DiVito left the scene of the accident and continued driving, only to crash into a tree a mile away.

Law enforcement officers say that Dr. DiVito has already been convicted of his third DWI. His previous accidents included two car accidents and one boating accident, one of these even killing a couple from Greece. Divito's criminal defense lawyers blamed the state's system for their client's mistakes. They argued that the rehabilitation centers did not do their job in helping DiVito get past his alcoholism, otherwise this would not have happened. Because DiVito had a recurring pattern of intoxication while driving, his lawyers believe that additional help was required in order for him to be healthy.

The district attorneys, however, did not agree, saying that DiVito should be held fully responsible for his conscious decision to become intoxicated and then drive a vehicle. His repeat offenses were not a reason to blame the state for his crimes. According to a New York news station, the DMV declared that if someone has had their license revoked 4 times, whether for DWI or other offenses, then their license will be taken away for life as a means of protection for both the offender and the public.
