What Are the Penalties for a DWI in Texas?

Second DWI offense:

  • A maximum fine of $4,000
  • Up to one year in jail

  • Annual fee between $1,000 and $2,000 for three years to keep driver’s license

Third DWI offense:

  • $10,000 fine
  • Up to 10 years in prison
  • Installation of Ignition Interlock Device (two or more DWIs in five years)
  • Up to two years loss of driver’s license
  • Annual fee between $1,000 and $2,000 for three years to keep driver’s license

If there was a minor in your vehicle under the age of 15 at the time that you were driving under the influence, the prosecutor may decide to charge you with child endangerment. In that case, you face up to a $10,000 fine, up to two years in jail, and the loss of your driver’s license for 180 days.
