What Happens If My Kids Were in the Car When I Was Arrested for DWI?

Alcohol has been a mainstay at family gatherings, holiday parties, and after work celebrations for years. Whether you are drinking beer at a Super Bowl party, enjoying a celebratory glass of champagne on New Year’s, or drinking wine on Thanksgiving, alcohol is often circulating around at gatherings with friends and family, many of which you may have brought the kids to.

As we all know, drinking and driving don’t mix. According to the Texas Department of Transportation, about every 20 minutes in Texas, someone is injured or killed in an alcohol-related crash. Unfortunately, sometimes there is a fine line between drinking below and above the “legal limit,” and it is easy to make mistakes when it comes to this measurement and exercising good judgment.

In Texas, you can be charged with Driving While Intoxicated ( DWI) when you have been caught driving with a blood or breath alcohol concentration (BAC) of .08%. However, you can be considered impaired by alcohol or drugs regardless of your BAC reading.
