Conservative Judges to Weigh Immigration Issues

Though the Supreme Court’s decisions regarding same-sex marriage and the Affordable Car Act were good news to President Obama, on Monday, he received bad news regarding his immigration initiatives that have been delayed in federal court.

The Fifth Circuit Court of Appeals made an announcement, revealing the identities of the three-judge panel that will be hearing the case next week. Two of the judges are the same conservative appointees who were unwilling to unblock Obama’s programs in May.

Though this court is very conservative, the Obama administration was hoping that more friendly judges would oversee the case, however, their hopes have now been dashed.

In May, Justice Department lawyers requested that the appeals court allow Obama’s highly controversial immigration actions go into effect pending the appeal; the appeals court denied their request.

The refusal to unblock the programs was a victory for 26 states, with Texas in the lead, who challenged the Obama administration’s actions, which were blocked by a Texas District Court judge in February.

What does the May decision mean to undocumented immigrants? It means that while the issue is being appealed in the courts, undocumented immigrants are not able to apply for programs that protect them from the threat of deportation.

The two programs at issue are the Deferred Action for Parents of Americans and Lawful Permanent Residents and the expansion of the 2012 Deferred Action for Childhood Arrivals program, which allows teenagers and young adults who were born abroad but raised in the U.S., to apply for employment authorizations and to be protected from deportation.
