Woman Shot in Attempted Robbery

DALLAS – At around midnight, March 9, a woman was shot insider her residence during an attempted robbery, said Dallas police.

As the woman entered her home in the 12500 block of Audelia Road, a person followed her inside and attempted to rob her on Monday. A struggle ensued, and the robber shot her, according to Dallas Police Department Spokeswoman Monica Cordova.

Ambulance were called to the scene and the victim was transported to Texas Health Presbyterian Hospital, where she is reported to be in stable condition.

Texas Robbery Statute

In Texas, the crime of robbery is covered under Section 29.01-29.03 of the Texas Penal Code. Under Section 29.02, a person commits robbery if during the offense, he or she:

  • Intentionally, knowingly, or recklessly causes bodily injury to another; or
  • Intentionally or knowingly threatens another imminent bodily injury or death.

An offense under Sect. 29.02 is a felony of the second degree, punishable by a maximum $10,000 fine and up to 20 years in prison.

Penalties for Aggravated Robbery

Under Section 29.03, a person commits “aggravated robbery” if during the offense, he or she:

  • Causes serious bodily injury;
  • Uses or displays a deadly weapon;
  • Causes bodily injury to another; or
  • Threatens or places another in fear of bodily injury or death, and the victim is 65 or older, or disabled.

Under Section 12.32, aggravated robbery is a felony of the first degree, punishable by up to a $10,000 fine, and anywhere between 5 years and life imprisonment.
