Get the Facts from Our Plano Social Security Disability Lawyers
Medicare is a program for individuals 65 years or older who are suffering disabilities and require assistance obtaining health insurance. It is not guaranteed that you will receive Medicare benefits, but it is important to have as much information as you possibly can.
Waiting Period & Exceptions
There is a 29-month waiting period from the date that SSDI benefits were granted for Medicare to begin. If your disability onset date was back far enough in time, you may have already served part or all of the 2-year waiting period. Claims that have to go through the appeals process can take up to 2 years to reach a final decision. That time is taken into account when calculating the 2-year waiting period. Social Security rules allow for a maximum of 12 months of retroactive benefits. There are, however, a few exceptions to the 2-year waiting period. Those claimants with end-stage renal disease kidney failure and those who require ongoing dialysis or a kidney transplant can receive Medicare benefits in the 3rd month after their dialysis began. Also, those who suffer from amyotrophic lateral sclerosis (ALS) can also collect Medicare benefits as soon as they are eligible.
