Who Is Allowed To File Under NVICP?

Under the National Vaccine Injury Compensation Program, anyone can file a petition for a vaccine injury, regardless of age or citizenship status. The only requirements are:

  • The effects of the injury lasted for more than 6 months after the vaccination
  • The injury resulted in hospitalization and surgical intervention
  • The injury resulted in death

The following parties can also file a claim under NVICP:

  • A parent or legal guardian of a child or disabled adult injured by a vaccine
  • The legal representative of the estate of a deceased person injured / killed by a vaccine

Vaccines covered under the National Vaccine Injury Compensation Program must have been administered in the United States. The only exceptions to this requirement are:

  • The vaccinated induvial was serving abroad as a member of the Armed Forces or as a U.S. Government employee, or is the dependent of this type of citizen
  • The vaccine was made by a U.S. manufacturer and the person filing the petition returned to the country within 6 months of being vaccinated
