Benefit Recalculations
The Social Security Administration (SSA) can revise a recipient’s payment based on updated income information, corrections to work history, or changes in program rules. When those revisions produce a lower payment than you’re entitled to, we can help you challenge the calculation and pursue a correction.
Cost-of-Living Adjustment Discrepancies
The SSA applies annual cost-of-living adjustments (COLAs) based on the Consumer Price Index for Urban Wage Earners and Clerical Workers (CPI-W). When a COLA is misapplied — or when an offsetting Medicare premium increase eliminates the adjustment — your net benefit can stagnate or fall. Recipients have the right to request reconsideration through the SSA’s appeals process.
Overpayment Disputes
An overpayment occurs when the SSA determines it paid more than a recipient was entitled to, often because a change in income, employment, marital status, or living situation wasn’t reflected in the SSA’s records. The SSA sends a Notice of Overpayment demanding repayment, but recipients have options: a reconsideration appeal, an overpayment waiver, or a negotiated payment arrangement.
Overpayment Notices: What’s at Stake & Why Timing Matters
The SSA’s Notice of Overpayment states the amount owed and gives you a window to respond. If you don’t act within 30 days of the notice date, collection begins. For SSDI overpayment notices issued on or after April 25, 2025, the SSA applies a 50% default withholding rate — meaning up to half of each monthly benefit check can be withheld until the debt is repaid. For SSI recipients, the withholding rate remains at 10%. If you no longer receive benefits, the SSA may collect through federal tax refund withholding or wage garnishment.
Filing a reconsideration appeal or waiver request within that 30-day window can pause collection while the SSA reviews your case. Missing the window doesn’t end your options, but it does mean collection can begin before your dispute is resolved.
Your Legal Options: Appeal, Waiver, or Arrangement
Understanding which path fits your situation is the first practical step.
- Reconsideration Appeal: Challenges whether the overpayment occurred at all, or disputes the stated amount. Must be filed within 60 days of the notice; filing within 30 days can pause collection during review.
- Overpayment Waiver: Asks the SSA to forgive the debt entirely. To qualify, you must show the overpayment wasn’t your fault and that repayment would cause financial hardship. A waiver can be filed at any time, and if approved, eliminates the debt. If denied, you can request a hearing before an ALJ.
- Payment Arrangement: If you acknowledge the overpayment but can’t repay it in full, the SSA may agree to partial payments or an extended schedule based on your income and basic living expenses.
