Texas’s Non-Subscriber System & What It Means for Your Claim

Texas is the only state where private employers may opt out of carrying workers’ compensation insurance. An employer that opts out is called a non-subscriber. If your employer is a non-subscribing employer, you generally may have the right under Texas Labor Code Section 406.033 to bring a direct negligence lawsuit against them rather than filing through a workers’ comp system.

That distinction carries real weight. A non-subscribing employer generally can’t raise the common-law defenses of contributory negligence, assumption of the risk, or a co-employee’s negligence against your lawsuit. Those defenses exist to limit or defeat injury claims, and their absence can significantly shift the litigation landscape in your favor.

If your employer does subscribe to workers’ compensation, ordinary negligence claims are generally channeled through that system. However, if a workplace fatality resulted from the employer’s gross negligence (generally meaning an extreme degree of risk combined with conscious indifference to others’ safety), the deceased worker’s surviving spouse or heirs may still be able to pursue additional damages outside the standard workers’ comp framework.
