It’s common knowledge that people across the United States get involved in illegal drug activities. From marijuana possession to prescription drug fraud to drug sales, trafficking and everything in between –drug-related crimes have plagued our society for decades. And being in Texas with such a close proximity to the Mexican border, we have a huge problem with drug trafficking.
Illegal drug activity affects every part of our culture. Quite a few high school students and Baby Boomers smoke pot. Street gangs are involved with trafficking and sales of marijuana, cocaine, and heroin. College students use ecstasy, pot and mushrooms, while people of all ages abuse prescription drugs – even on the black market. In other words, illegal drug use is not limited to the homeless or street gangs – nearly every faction of our society is involved. Few are immune.
In light of the drug issue that impacts Texans, here is a breakdown of the basic penalties for drug-related crimes in the Lone Star State:
Possession of a Controlled Substance
- The minimum punishment is up to 180 days in jail, or a maximum fine of $2,000, or a fine and imprisonment.
- The maximum punishment is 10 to 99 years in prison, and a maximum fine of $250,000.
Marijuana Possession
- Still criminalized under Texas law, the minimum punishment is up to 180 days in jail, or by a fine up to $2,000, or by a fine and incarceration.
- The maximum punishment for a marijuana offense is 5 to 99 years behind bars and by a maximum fine of $50,000.
Manufacture or Delivery of a Controlled Substance
- The minimum punishment is 180 days to 2 years in jail and a maximum fine of $10,000.
- The maximum punishment is 15 years to 99 years in prison, and a maximum fine of $250,000.
